2 травня комітет з питань гуманітарної та інформаційної політики розглянув звернення Суспільного щодо тиску й поширення токсичних наративів про медіакомпанію з боку нардепки Мар'яни Безуглої. Зрештою ухвалили дві заяви. Перша — про недопустимість тиску на Суспільне та надання йому повного фінансування, згідно з законом. Друга — про необхідність дотримання принципів свободи слова щодо всіх медіа, аби громадяни мали доступ до верифікованої інформації.

Про це йшлося в трансляції засідання на ютуб-каналі Суспільного.

На засіданні двох комітетів також були присутні керівники Суспільного, представники Мінкульту, Нацради з питань телебачення та радіомовлення, громадські організації.

Микола Чернотицький, голова правління Суспільного, заявив, що не хотів би допущення тиску від народних депутатів. Стосовно телемарафону, Чернотицький зазначив, що напередодні відбулася конструктивна бесіда з іншими медіагрупами.

«Для нас важливо зберігати єдність і не забувати, що війна. Або ми залишаємося в паритетних умовах, або розгляньмо модель, коли ми розширюємо мовлення на своєму Першому каналі, але я маю розуміти, що це робиться легально, не суперечить указам президента та рішенню РНБО. Ми готові до таких сценаріїв, але хочемо знати, що ніхто не буде звинувачувати, що ніхто не підважив національну безпеку своїм контентом. Найбільше тригерить, що це все переростає в скандал, який точно може вдарити по країні через донорів та інше», — сказав голова правління.

Проєкту рішення заздалегідь не готували. Тому голова Комітету Верховної ради з питань гуманітарної та інформаційної політики Микита Потураєв за підсумками живого обговорення запропонував на основі інформаційно-довідкових матеріалів НСТУ, наданих комітету, зробити заяву про неприпустимість тиску та розповсюдження неправдивої інформації про діяльність і результат роботи національного суспільного мовника. Також зробити заяву про потребу повністю фінансувати Суспільне, згідно з законом.

Друга окрема заява — необхідність дотримання принципів свободи слова і свободи медіа, про необхідність забезпечення всіх громадян України до верифікованої перевіреної інформації. В цій заяві також звернутися до каналів-засновників телемарафону щодо необхідності дотримання принципу паритетності мовлення під час війни.

Пропонувалося окреме звернення — до апарату РНБО, щоби той дав роз'яснення щодо можливості відновлення мовлення Суспільного в повному обсязі на телеканалі Перший, згідно з ліцензією. Але комітет не підтримав це звернення.

Також Потураєв пропонував окремим рішення звернутися до Нацради з питань телебачення та радіомовлення щодо можливості відновлення мовлення НСТУ на їхніх каналах, згідно з ліцензіями (за умови звернення самого Суспільного). Це також відхилили.

Світлана Остапа, голова наглядової ради Суспільного, сказала, що Суспільне потребує письмових гарантій, що в разі мовлення на всіх своїх платформах у компанії не заберуть телеканал Перший і не звинуватять у порушенні законодавства.

Депутат Микола Княжицький наголосив, що втручання в роботу суспільного мовника шкодить європейській інтеграції України.

Володимир В'ятрович запропонував скоротити телемарафон, бо він дискредитує Україну на міжнародній арені і віджив себе.

Що передувало обговоренню на комітеті

24 квітня народна депутатка Мар’яна Безугла опублікувала у Facebook кілька постів щодо доцільності фінансування шести державних каналів, зарахувавши до «державних» і Суспільне Мовлення.

Зокрема, вона зазначила, що Суспільне, «Дом» і FreeДом мають мізерні охоплення і диверсифікують кошти”, і запропонувала залишити фінансування лише одного каналу, зокрема «Ради» або Суспільного.

Пізніше, 27 квітня, в іншому пості Безугла написала, що з кількох джерел їй стало відомо про існування схеми, за якою чоловіків нібито «прилаштовують на Суспільне заради броні на пів ставки». Однак за документами ці люди начебто працюють на повну ставку, заявила тоді нардепка. Безугла додала, що готує запит.

Що відомо про ідеї забрати вечірні праймові слоти Суспільного в телемарафоні

Секретар наглядової ради Суспільного Вадим Міський написав, що зʼявилися ідеї забрати вечірні праймові слоти Суспільного в телемарафоні.

«Як мовник, що виробляє найбільш збалансовані новини, що відповідають журналістським стандартам — ми ставимо питання про передачу всіх праймів Суспільному», — написав Міський.

Голова наглядової ради Суспільного Світлана Остапа написала у Facebook, що Суспільне пропонують прибрати з вечірніх слотів телемарафону «Єдині новини», і залишити йому лише нічні та ранкові слоти.

«Ми вимагаємо або усіх вечірніх ефірів у слоті, або щоб був паритет, як раніше, щоб в усіх виробників контенту були і вечірні, і денні, і нічні слоти», — прокоментувала Світлана Остапа.

Своєю чергою голова комітету Верховної Ради з питань свободи слова Ярослав Юрчишин заявив, що якби збалансованість телемарафону була такою, якої дотримується принаймні Суспільне, зауважень від Держдепу США до марафону не було б.

Телемарафон у звіті Держдепу США про порушення прав людини в Україні

Держдепартамент США вніс телемарафон «Єдині новини» до свого звіту про порушення прав людини в Україні за 2023 рік. У документі зазначають, що законодавство України передбачає свободу преси, проте марафон «дотримується урядової лінії» та демонструє контроль з боку держави.

У звіті згадуються медіа, які не допустили до участі в «Єдиних новинах» та тиск з боку Офісу президента навесні 2022 року. Йдеться про «5 канал», «Прямий» та «Еспресо». Також у цій заяві йдеться про те, що «уряд забороняв, блокував або застосовував санкції до ЗМІ та окремих журналістів, які вважалися загрозою національній безпеці або які висловлювали позиції», які влада вважала як підрив суверенітету України.

Коментуючи свободу вираження поглядів, автори звіту відзначили, що, за деякими винятками, люди в Україні можуть публічно і приватно критикувати владу та обговорювати питання, що становлять суспільний інтерес без страху перед «офіційними репресіями».

Verkhovna Rada Committee considers pressure on Suspilne Ukraine and approves two statements

On 2 May, the Committee on Humanitarian and Information Policy considered an appeal filed by Suspilne Ukraine regarding pressure and dissemination of toxic narratives about the media company on the part of MP Mariana Bezuhla. In the end, two statements were approved. The first one read that any pressure on Suspilne Ukraine was inadmissible and that it should be fully funded as required by law. The second one read that the principles of freedom of speech in all media should be followed so that citizens could have access to verified information.

This was discussed in the broadcast of the meeting on the Suspilne YouTube channel.

The meeting of the two committees was also attended by heads of Suspilne Ukraine, representatives of the Ministry of Culture, the National Council on Television and Radio Broadcasting, and NGOs.

Mykola Chernotytskyi, Head of the Managing Board of Suspilne Ukraine, said that he would not like to allow pressure from MPs. Regarding the telethon, Mr Chernotytskyi noted that a productive discussion with other media groups had taken place the day before.

"It is important for us to remain united and remember that Ukraine is at war. Either we remain in parity or let's consider a model where we expand broadcasting on our Pershyi Channel, but I need to understand that this is done legally and is in line with the presidential decrees and the decision of the National Security and Defense Council (NSDC). We are ready for such scenarios, but we need to know that no one will blame us and that no one has undermined national security with their content. The biggest trigger is that this is turning into a scandal that can definitely hit Ukraine through donors and so on," explained the Head of the Managing Board.

No draft decision was prepared in advance. Therefore, following the live discussion, Mykyta Poturaiev, Chairman of the Verkhovna Rada Committee on Humanitarian and Information Policy, proposed to approve a statement reading that pressure and dissemination of false information about the activities and performance results of Suspilne Ukraine are inadmissible based on the information and reference materials provided by Suspilne Ukraine to the Committee. He also proposed to approve a statement reading that Suspilne Ukraine should be fully funded as required by law.

The second specific statement read that the principles of freedom of speech and freedom of the media should be respected and that all citizens of Ukraine should be provided with access to verified and reliable information. The statement also addressed the telethon launching channels reading that the principle of broadcasting parity in times of war should be respected.

A separate petition to the National Security and Defense Council was proposed seeking to provide clarification on whether it was possible for Suspilne Ukraine to resume broadcasting in full on the Pershyi TV channel, according to the licence. However, the committee did not support this petition.

Mr Poturaiev also proposed to appeal to the National Council on Television and Radio Broadcasting by a separate decision seeking to resume broadcasting for Suspilne Ukraine on their channels, according to the licences (if Suspilne Ukraine requests so). That was also rejected.

Svitlana Ostapa, Head of the Supervisory Board of Suspilne Ukraine, commented that Suspilne Ukraine needed written guarantees to ensure that if it broadcast on all its platforms, the company would keep the Pershyi TV channel and be free from any accusations of violating the law.

MP Mykola Kniazhytskyi emphasised that interference in the activities of the public service broadcaster harmed Ukraine's European integration.

Volodymyr Viatrovych suggested that the telethon should be shortened as it discredited Ukraine in the international arena and was no longer relevant.

WHAT PRECEDED THE COMMITTEE'S DISCUSSION

On 24 April, MP Mariana Bezuhla published several posts on Facebook on the feasibility of funding six state-owned channels, including Suspilne Ukraine.

In particular, she noted that Suspilne, Dom and FreeDom had poor reach and diversified funds, and suggested that only one channel, namely Rada or Suspilne, should be funded.

Later, on 27 April, Ms Bezuhla wrote in another post that she had learned from several sources about a scheme whereby men were allegedly "hired by Suspilne Ukraine as part-time employees for the sake of exemption from military service". However, according to the documents, these people seemed to be working full-time, the MP said at the time. Ms Bezuhla added that she was preparing a request.

WHAT IS KNOWN ABOUT IDEAS TO TAKE AWAY THE EVENING PRIME SLOTS OF SUSPILNE UKRAINE IN THE TELETHON

Vadym Miskyi, Secretary of the Supervisory Board of Suspilne Ukraine, wrote that there were ideas to take away the evening prime slots of Suspilne Ukraine in the telethon.

"As a broadcaster producing the most balanced news meeting the standards of journalism, we are seeking that all primes should be given to Suspilne Ukraine," Mr Miskyi wrote.

Svitlana Ostapa, Head of the Supervisory Board of Suspilne Ukraine, wrote on Facebook that Suspilne Ukraine was offered to be removed from the evening slots of the United News telethon leaving it with only night and morning slots.

"We demand either all evening broadcasts in the slot or parity, as before, so that all content producers have evening, daytime and nighttime slots," commented Svitlana Ostapa.

In his turn, Yaroslav Yurchyshyn, Chairman of the Verkhovna Rada Committee on Freedom of Speech, stated that if the telethon had been balanced as much as Suspilne Ukraine ensures, there would have been no comments as to the telethon from the US Department of State.

TELETHON ON THE US DEPARTMENT OF STATE REPORT ON HUMAN RIGHTS VIOLATIONS IN UKRAINE

The US Department of State included the United News telethon in its 2023 report on human rights violations in Ukraine. The document says that Ukrainian laws provide for freedom of the press, however, the telethon "takes the government line" and demonstrates state control.

The report mentioned media outlets that were not allowed to be part of the United News telethon and pressure from the Office of the President as early as the spring of 2022. We are talking about Channel 5, Priamyi and Espreso Channels. The report also said that "the government banned, blocked, or sanctioned media outlets and individual journalists deemed a threat to national security or who expressed positions authorities believed undermined the country’s sovereignty and territorial integrity”.

Commenting on freedom of expression, the report noted that "with few exceptions, individuals in areas under Ukrainian government control could generally criticize the government publicly and privately and discuss matters of public interest without fear of official reprisal”.
